Terms of Service
Effective · Version 0.1 (draft)
These terms are the agreement between you and SkiJapow. By using the site or booking a trip, you accept them.
1. Who we are and what SkiJapow does
SkiJapow (“SkiJapow”, “we”, “us”) operates a website that lets you design a day-by-day winter itinerary in Japan and request the activities in it — skiing, snowboarding, guided tours, transfers and similar experiences — from independent local suppliers.
We act as an intermediary and booking agentbetween you and the suppliers who actually provide each activity. The activities themselves are delivered by those suppliers, not by SkiJapow. We arrange and collect payment for your booking and coordinate confirmation on your behalf. Where these terms conflict with a supplier’s own terms for a specific activity, the supplier’s terms govern the delivery of that activity, and these terms govern your relationship with SkiJapow.
2. Eligibility and your account
You must be at least 18 years old and able to enter into a binding contract to book through SkiJapow. You may book on behalf of others in your party, but you are responsible for them and for making sure the details you give us for each traveller are accurate.
- You may check out as a guest, or create an account to save itineraries and view bookings.
- If you create an account, keep your credentials secure — you are responsible for activity under it.
- Tell us promptly if you believe your account has been used without your permission.
3. Booking, confirmation and payment
Building an itinerary and starting checkout is a request, not a confirmed booking. When you check out we authorise (place a hold on) your payment method for the total, then send your requests to the relevant suppliers. Your card is only charged for the activities suppliers confirm; anything not confirmed is released. The full mechanics — authorisation, capture, partial confirmation and expiry — are set out in our Booking Terms, which form part of this agreement.
Prices are calculated and confirmed by us server-side at checkout. We make every effort to display prices accurately, but if a genuine and obvious error means a price is clearly wrong, we may cancel the affected item and release or refund any amount taken for it.
4. Changes, cancellations and refunds
Your rights to change or cancel a booking, and what is refundable, are described in our Cancellation & Refund Policy. Individual activities may also carry supplier-specific cancellation windows, which we show before you book. Weather and safety cancellations are common in winter mountain activities and are covered there.
5. Your responsibilities on the trip
Winter mountain activities carry inherent risk. You are responsible for:
- Making sure every member of your party meets the age, fitness, experience and equipment requirements shown for each activity.
- Arranging appropriate travel and medical insurance, including cover for winter sports.
- Following the instructions and safety rules of each supplier and guide.
- Holding valid travel documents (passport, visa) — SkiJapow does not arrange these.
A supplier or guide may refuse participation, without refund, if a participant is unfit to take part safely, is under the influence of alcohol or drugs, or ignores safety instructions.
6. Acceptable use
You agree to use SkiJapow lawfully and not to misuse it. The specifics are in our Acceptable Use Policy. In short: don’t attack, scrape, overload or attempt to defraud the service, and don’t book in someone else’s name without their permission.
7. Intellectual property
The SkiJapow name, logo, site design, text, and curated content are owned by us or our licensors and are protected by intellectual-property law. You may use the site to plan and book your own trips and share an itinerary link, but you may not copy, resell or systematically extract our content without permission. Photographs and supplier descriptions may be licensed from third parties and remain their property.
8. Our liability
Because SkiJapow acts as an intermediary, the supplier delivering each activity is responsible for how that activity is performed. We are responsible for arranging the booking with reasonable care and skill.
- We do not exclude or limit liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, or for fraud.
- Subject to that, we are not liable for a supplier’s acts or omissions, for events outside our reasonable control, or for indirect or consequential loss.
- Where we are liable, our total liability to you for a booking is limited to the amount you paid to SkiJapow for that booking.
Nothing in these terms affects any non-excludable rights you have as a consumer under the law that applies to you.
9. Changes to these terms
We may update these terms as the product develops. If a change is material we will take reasonable steps to notify you. The version that applies to a booking is the one in force when you completed that booking. Continuing to use the site after an update means you accept the updated terms.
10. Governing law and disputes
The governing law and the courts that handle disputes will be confirmed once SkiJapow’s operating entity is established (see the prototype notice above). We aim to resolve any complaint quickly and fairly — please contact us first so we can try to put things right.
